Proper Gander ("Proper Gander", "we", "us" or "our") is an Australian business based in Victoria, Australia.

This Privacy Policy explains how we collect, use, store and disclose personal information when you visit propergander.au (the "Site"), submit an enquiry, book or request a conversation, or otherwise interact with us through the Site.

Our Site and services are primarily intended for Australian businesses and Australian users.

This Privacy Policy applies specifically to information collected through or in connection with our public website before a paid client engagement begins.

It does not govern information collected and handled as part of a paid Proper Gander client engagement. Information relating to paid client work is handled under the applicable proposal, service terms and our separate business security and information-handling practices.

2. Our approach to privacy

We aim to collect only the information reasonably needed to:

• operate and improve the Site
• understand how people use the Site
• respond to enquiries
• determine whether our services may be relevant to you
• communicate with people who contact us
• measure the effectiveness of our website and marketing
• protect our website and business systems
• meet our legal and record-keeping obligations.

We do not sell or rent your personal information.

We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and Australian Privacy Principles where they apply to Proper Gander.

Even where a particular legal requirement does not apply, we aim to follow reasonable privacy, security and information-minimisation practices.

7. Google Analytics

We currently use Google Analytics 4 (GA4) to help us understand how people find and use our Site.

Google Analytics may collect information including:

• online identifiers used to distinguish users and sessions.

Google states that GA4 uses IP addresses during collection for functions such as approximate location and routing, and discards raw IP addresses before they are logged in Analytics. GA4 also uses a first-party identifier such as the _ga cookie where analytics storage is enabled.

We do not intentionally send your name, email address, phone number or free-text enquiry contents to Google Analytics.

Information collected through Google Analytics is handled in accordance with Google's applicable terms, privacy practices and the settings configured for our Analytics account.

8. Cookies and similar technologies

The Site may use cookies and similar technologies to operate correctly and understand website activity.

Cookies are small files or identifiers that a website can store on or access from your device.

Proper Gander may introduce the Meta Pixel and related Meta advertising technologies in the future.

• online identifiers

Meta may combine information received from websites using Meta Business Tools with information associated with users of its services. Meta describes its Pixel as one way businesses provide it with information about people's activity on other websites and apps.

We do not intend to configure Meta Pixel to collect the contents of free-text enquiry fields or sensitive personal information.

If targeted advertising technologies are enabled, we will take reasonable steps to provide appropriate notice and an available method of opting out where required by applicable Australian law.

The OAIC recommends that organisations using third-party tracking pixels minimise the information transmitted, clearly disclose their use and allow individuals to opt out where personal information is used for targeted advertising.

Information submitted through an enquiry form is primarily used to:

• determine whether a conversation or service may be appropriate

• understand how the enquiry reached Proper Gander.

Enquiry information may be stored or processed using systems used by Proper Gander for website hosting, email and customer relationship management.

If you later become a paying client, relevant information may become part of your client record.

Information collected solely for the purpose of delivering a paid engagement falls outside the scope of this website Privacy Policy.

We may send you marketing or promotional communications where you have consented or where we are otherwise permitted to do so under Australian law.

Australian commercial electronic messaging laws require appropriate consent and require marketing messages to identify the sender and provide an effective way to unsubscribe.

We may also disclose information where reasonably necessary to comply with Australian law, respond to lawful government or court requests, protect our rights or systems, investigate fraud or security incidents, or obtain professional advice.

13. Overseas processing

Although Proper Gander operates from Australia, some of the technology providers we use operate internationally.

As a result, information may be processed, stored or accessed outside Australia, including in the United States and other countries in which our technology providers operate.

Providers such as Google, Meta and Duda operate international technology infrastructure.

Where Australian privacy law applies, we take reasonable steps appropriate to the circumstances when selecting and using service providers that may process personal information outside Australia.

14. Visitors outside Australia

Proper Gander is an Australian business and the Site is primarily directed to Australian businesses and customers.

We do not presently operate the Site for the purpose of actively targeting or offering Proper Gander services to people in the European Union, European Economic Area, United Kingdom or United States.

The fact that the Site may be accessible from another country does not mean Proper Gander is actively conducting business in that country.

If you access the Site from outside Australia, information may still be processed as described in this Privacy Policy.

Privacy laws in your location may provide rights that apply to a particular interaction despite our Australian focus. Where another law validly applies to Proper Gander and gives you rights that cannot lawfully be excluded, we will deal with those rights as required.

Nothing in this Privacy Policy is intended to remove a right that cannot legally be excluded.

Our internal security standard specifically requires MFA on systems including email, Zoho, Duda and domain accounts, restricted access and collection only of information needed for the relevant purpose.

No website, internet transmission or electronic storage system can be guaranteed to be completely secure.

If a security incident occurs, we will assess the circumstances, take reasonable steps to contain and correct the issue and comply with any applicable notification obligations.

16. How long we keep information

We keep personal information only for as long as reasonably required for the purpose for which it was collected, or where retention is reasonably required for legal, security, record-keeping or business purposes.

Retention periods may depend on:

• whether an enquiry is still active
• whether further communication is reasonably expected

• legal or record-keeping obligations
• the retention settings of technology providers we use.

When information is no longer reasonably required, we may delete, de-identify or securely dispose of it, subject to normal backup systems and legal retention requirements.

Proper Gander's internal file-control standard also requires that duplicate personal information or unnecessary drafts are not retained without a business reason.

The Site is intended for businesses and adult users.

We do not knowingly seek to collect personal information through the Site from children.
